Kampagnen-Aufruf: “Racial Profiling kostet – Racial Profiling costs – Le contrôle au faciès coûte cher“

…nicht nur die Menschen, die diskriminierende Polizeimethoden erfahren, sondern in Zukunft auch diejenigen, die sie durchführen. Mit diesem Ziel geht die Kampagne „Stop Racial Profiling“ in die nächste Runde.
Die Wahrnehmung von Racial Profiling in der Öffentlichkeit wächst, seitdem der Fall eines Schwarzen jungen Mannes auf der Zugstrecke Koblenz – Frankfurt/Main bekannt geworden ist, der gegen eine Form des Racial Profiling – selektive Personenkontrollen – geklagt hatte. Erst in der Berufung hatte das Oberverwaltungsgericht Rheinland-Pfalz die erstinstanzliche Entscheidung aufgehoben und die Maßnahme als Grundgesetzwidrig eingestuft. Als Folge dieser Entscheidung wurde die Bundespolizei verpflichtet, sich bei dem Kläger zu entschuldigen.
Es gibt eine Vielzahl von traumatisierenden Vorfällen, die sich tagtäglich hinter schalldichten Türen auf Polizeirevieren ereignen. Von offizieller Seite wird meist von “bedauerlichen Einzelfällen durch Polizeibeamt_innen” gesprochen. Genau an diesem Punkt setzt die geplante Kampagne mit der Vorlage eines Beschwerdebriefes an die Bundespolizei an.
Racial Profiling dokumentieren.
Das System ist simpel: Einfach die von einer für KOP aktiven Strafrechtlerin formulierten Protokollvorlage ausfüllen und an die Bundespolizei senden – eine Kopie geht an KOP (Kampagne für Opfer rassistischer Polizeigewalt). Ziel der Aktion ist es, eine Briefwelle an die Bundespolizei auszulösen. Als Behörde kann sie mehrmalig auftretene Beschwerden nicht einfach ignorieren. Damit wird ein doppelter Zweck erfüllt: Einerseits werden Menschen durch die Briefe auf einem niedrigschwelligen Niveau handlungsfähig gemacht. Andererseits wird so das strukturelle Problem des Racial Profiling sichtbar und dokumentierbar.
Wem Racial Profiling widerfährt oder wer es beobachtet ist ab jetzt aufgerufen, seine Stimme zu erheben.

 …not only those who are confronted with discriminatory methods of policing, but also those who engage in such practices. By setting this goal, the campaign „Stop Racial Profiling“ continues.

The public´s awareness of racial profiling is on the rise. This is a consequence of the racial profiling case of a young Black German man travelling by train from Koblenz to Frankfurt/Main. The aforementioned man sought legal action against the use of racial profiling (selective passport controls). Only after filing an appeal, the Higher Administrative Court of Rheinland Pfalz reversed the lower court´s initial ruling. The police practice of racial profiling was declared unconstitutional in October 2012. As a result of this decision, the Federal Police officially apologized to the plaintiff.

 There are numerous traumatizing incidences that occur day in and day out behind sound -proof doors of police stations. The officials, however, speak of „isolated unfortunate incidents“. For that reason, this sample letter to the Federal Police will provide them with information to the contrary.

The approach is simple: Just fill out the sample letter drafted by a lawyer working with KOP and send it to the Federal Police – Please mail one copy to KOP (Campaign for victims of racist police violence, see address below). The goal is to cause a wave of letters to the Federal Police reflecting actual events. As an official state institution, they cannot simply ignore repeated complaints. Thus, two goals are being achieved: Firstly, people are proactive in deterring this kind of victimization. Secondly, the structural nature of racial profiling becomes visible and documentable.

non seulement ceux et celles qui subissent les mesures policières discriminatoires mais à l’avenir aussi ceux et celles qui les appliquent, tel est l’objectif que la campagne « stop racial profiling » (stop le contrôle au faciès) s’est fixé pour sa prochaine étape.
L’opinion publique a été sensibilisée à ce que représente la pratique policière du contrôle au faciès depuis que le cas d’un jeune Noir qui avait été contrôlé par la police – au faciès – lors d’un voyage en train entre Coblence et Francfort-sur-le-Main et qui, par la suite, a porté plainte contre cette forme de profilage racial, a connu un certain écho médiatique. Le tribunal administratif supérieur de la Rhénanie-Palatinat (Rheinland-Pfalz) a finalement annulé le jugement de première instance et reconnu anticonstitutionnel la mesure en question. Suite à cette décision, la police fédérale allemande (Bundespolizei) a dû s’excuser auprès du plaignant.
Dans les commissariats de police, à huis clos, se produisent quotidiennement des incidents traumatisants. Les déclarations officielles parlent alors de cas isolés et de déviances exceptionnelles de la part des agents de police impliqués. C’est justement sur ce point que la nouvelle campagne souhaite intervenir.
Documentation d’incidents de contrôle au faciès
L’idée est bien simple: Il suffit de remplir le formulaire rédigé par une experte en code pénal afin de faire une déposition (voir ci-dessous) et l’envoyer à la Bundespolizei; n’oubliez pas d’envoyer une copie à KOP. L’action a pour but de faire monter la pression sur la Bundespolizei qui elle, en sa qualité d’autorité publique, ne peut se permettre d’ignorer un grand nombre de plaintes fréquentes. Cela permet aux personnes concernées d’entrer facilement en action tout en rendant visible les structures racistes sous-jacentes aux contrôles d’identité au faciès.
Chacune et chacun qui subit le contrôle au faciès ou qui en devient témoin est désormais appelé à élever sa voix contre cette pratique discriminatoire. Vous trouvez le modèle de lettre en allemagne type ici.
